DEFINITIONS
‘Site’ means the web page www.Featured.ie together with all content contained therein.
‘Product/Service’ means any product or service or activity against which a Voucher purchased on Featured.ie may be redeemed.
‘Business Day’ means any weekday, other than a bank or public holiday in the Republic of Ireland.
‘Customer’ means any person who purchases a Voucher from Featured.ie.
‘Deal Expiry’ means the date on which any advertisement/promotion posted on the Site comes to an end and may no longer be purchased by a Customer.
‘Voucher’ means a voucher purchased from Featured.ie which is capable of being redeemed by the Customer against a Product/Service provided by a Supplier in accordance with the Terms.
‘Supplier’ means a third party supplier whose obligation it is to provide a Product/Service directly to the Customer.
‘The Advertised Price’ means the price at which a Product/Service is advertised on Featured.ie and does not constitute at law an offer to sell any Product/Service at the Advertised Price.
‘Terms’ means the General Terms and the Specific Terms.
‘The General Terms’ means all of the terms and conditions as set out below.
‘The Specific Terms’ means any terms additional to the General Terms which apply to specific Vouchers or Products/Services.
‘Terms and Conditions of the Supplier’ means all express terms and conditions governing the contract between a Customer and a Supplier.
‘Tipping Point’ means the creation of an agreed minimum of provisional bookings as set out in the promotion of a Voucher on the Site.
GENERL TERMS / SPECIFIC TERMS
General Terms and Specific Terms apply to each Voucher sold. Specific Terms will be displayed on the Site in connection with each promotion displayed. Specific Terms may include, but will not be limited to, price, period during which a Voucher may be redeemed, age, health and size restrictions etc.
In the event of any contradiction between the General Terms and the Specific Terms in relation to a particular Voucher, the Specific Terms will prevail.
CONDUCT
This page states the terms and conditions under which you may use our Site. The Site is owned and operated by Collective Buying Power Ltd t/a Featured.ie which is a private company limited by shares. Registered in Ireland No. 482174. Registered office: 22 Northumberland Road, Ballsbridge, Dublin 4, Ireland. Please read these terms and conditions carefully. Your use of this Site constitutes acceptance of these terms and conditions. If you do not accept the terms and conditions, then you may not use the Site.
Featured.ie may revise these terms and conditions at any time by updating this posting. Any changes in these terms and conditions will be effective immediately when they are posted on the Site. We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms and conditions at any time.
You should visit this page periodically to review the terms and conditions, because they are binding on you.
YOUR USE OF THE SITE
Featured.ie authorises you to view and download a single copy of the Material (as defined below) on the Site solely for your personal, non-commercial use. The use of the Site and the Material is entirely at your own risk. Changes are periodically made to the Site and may be made at any time.
The contents of the Site, such as text, graphics, images, photographs, code and other material ("Material"), are protected by copyright, trade mark and other laws in both Ireland and overseas. You must retain all copyright, trademark and other proprietary notices contained in the original Material on any copy you make of the Material. You may not reproduce, display, publicly perform, distribute, sell or modify the Material or otherwise use the Material in any way for any public or commercial purpose or otherwise in breach of these terms and conditions. In particular, the use of the Material on any other web site or in a networked computer environment for any purpose is prohibited. All trademarks, service marks, and trade names are the property of Featured.ie or its suppliers.
The Material may contain inaccuracies or typographical errors. Featured.ie makes no representations about the accuracy, reliability, completeness, or timeliness of the Material or about the results to be obtained from using the Site or the Material. If you violate any of these Terms, your permission to use the Material automatically terminates and you agree to immediately destroy any copies you have made of the Material.
PROHIBITIONS OF USE
Featured.ie prohibits the use of the Site for any unlawful purpose. In addition to this, you agree not to use, nor allow any person under your control to use the Site for the following purposes:-
posting any incomplete, false or inaccurate information;
posting any information which is subject to confidentiality provisions (implied or express);
posting any information which, in our reasonable opinion, we consider to be defamatory, offensive, obscene, threatening, racist, sexist or discriminatory;
deleting, amending or in any way altering any material which has not been posted by you;
posting materials which are not your own work (in whole or in part) without having the consent of the original author; or
making use of the Site and/or the materials in a way which infringes the intellectual property rights of any other party.
In the event that Featured.ie considers that you are making any illegal and/or unauthorised use of the Site and/or your use of the Site is in breach of these Terms, we reserve the right to take any action that we deem fit, including terminating your use of the Site without notice and with immediate effect and, in the case of illegality, instigating criminal proceedings.
Notwithstanding any other provision of these Terms, we may, at any time and without giving any reason, terminate these Terms with you and deny you access to the Site.
FEATURED.IE's LIABILITY
The following provisions set out Featured.ie’s entire liability (including any liability for the acts and omissions of its employees, agents or sub-contractors) to you in respect of: (i) any breach of the contractual obligations arising under these Terms; and (ii) any representations, statements or tortuous act or omission (including negligence) arising under or in connection with these Terms; ("Event of Default"). These Terms do not prejudice the statutory rights, which you may enjoy if you are dealing as a consumer within the meaning of Irish law.
Featured.ie shall have no liability to you in respect of any Event of Default unless you shall have served notice of the same upon Featured.ie as soon as reasonably practicable after the date on which you became aware of the circumstances giving rise to an Event of Default or the date when you ought reasonably to have become so aware. Featured.ie shall have 30 days from the date of such notice in which to remedy an Event of Default hereunder.
Featured.ie shall not be liable, and shall not otherwise be deemed to be in breach of these Terms, for any failure to perform (or delay in performing) any of its obligations hereunder caused by circumstances beyond its reasonable control.
Featured.ie does not warrant that the Site will operate error-free or that the Site and its servers are free of computer viruses and other harmful elements. If your use of the Site or the Material results in the need for servicing or replacing equipment or data, Featured.ie is not responsible for those costs.
The Site and Material are provided on an "as is" basis without any warranties of any kind. Featured.ie and its suppliers, to the fullest extent permitted by law, disclaim all conditions and warranties, express or implied including any terms as to merchantability and fitness for particular purpose. Featured.ie and its suppliers make no warranties about the accuracy, reliability, completeness, or timeliness of the material, services, software, text, graphics or links. In particular, Featured.ie does not warrant that the use of the Material by you will not infringe third party rights.
Featured.ie may suspend the Site at any time and for any reason whatsoever, including but not limited to repairs or upgrades, and shall not be liable to you for any such suspension.
You expressly agree that use of the Site is at your sole risk. neither Featured.ie, its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that use of the Site will be uninterrupted or error free; nor do they make any warranty as to (i) the results that may be obtained from use of this site, or (ii) the accuracy, reliability or content of any information, service or merchandise provided through the Site.
This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action. You specifically acknowledges that Featured.ie is not liable for the defamatory, offensive or illegal conduct of other users or third-parties and that the risk of injury from the foregoing rests entirely with end user.
In no event shall Featured.ie, or any person or entity involved in creating, producing or distributing the Site or the contents hereof, and any software, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use this site. End user hereby acknowledges that the provisions of this section shall apply to all content on the Site.
In addition to the terms set forth above, neither Featured.ie, nor its affiliates, information providers or content partners shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within the Site, or for any delay or interruption in the transmission thereof to the end user, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including without limitation lost profits, punitive or consequential damages.
Featured.ie is not responsible for any content that a user, subscriber, or an unauthorized user may post on the Site. Any content that is posted or uploaded that is or may be deemed unsuitable can and may be taken down by Featured.ie. moreover, Featured.ie reserves the right to edit, change, alter, delete and prohibit any and all content that it, Featured.ie, deems unsuitable.
Featured.ie does not accept responsibility for inaccurate content and/or safety instructions, which are included on any Product/Service supplied.
DISCLAIMER OF CONSEQUENTIAL DAMAGES
In no event shall Featured.ie, its suppliers, or any third parties mentioned at the Site be liable for any damages whatsoever (including, without limitation, incidental, special and consequential damages, lost profits, lost goodwill or damages resulting from lost data or business interruption) resulting from the use or inability to use the Site or arising from the use, repair, service or maintenance of any equipment, whether based on statute, contract, tort, or any other legal cause, and whether or not Featured.ie is advised of the possibility of such damages.
YOUR OBLIGATIONS
You agree: that any information provided by you will be true, accurate, current and complete; and confirm that you are the authorised holder of any credit/debit card you may use on the Site; to notify us immediately of any changes to any information you have submitted to the Site; and to be available for delivery and to take delivery of any products ordered by you from the Site.
PRODUCT/SERVICE DESCRIPTION
Each Product/Service is sold subject to the General Terms and the Specific Terms.
THE EXPIRY OF A FEATURED.IE VOUCHER
Each Voucher sold by Featured.ie is subject to an individual expiry date which will not exceed six months. Some Vouchers may be redeemed solely on a specified date and other Vouchers may be redeemed within a specified period.
PLACING YOUR ORDER WITH FEATURED.IE
Any order made by you shall be deemed to constitute an irrevocable offer to purchase. The purchase procedure shall be as follows:-
1. You select a Voucher from Featured.ie and provide credit card details. The credit card transaction is not processed at that point but credit on your card may be reserved to the value of the price of the Voucher. The selection of a Voucher together with the provision of credit card details shall be deemed to constitute an irrevocable offer to purchase.
2. Step 1 above results in a provisional booking only and does not entitle the customer to receive the Voucher at the Advertised Price.
3. In the event that the Tipping Point is reached then at that point your provisional booking becomes a purchase and the credit card transaction will be processed. You will receive your Voucher by email. Each Voucher contains a unique code.
4. At the point that the Voucher is sent to you by email a contract comes into existence between you and the Supplier of the Product/Service. You will, in addition to being bound by these Terms, be bound by the Terms and Conditions of the Supplier. A link to the Terms and Conditions of the Supplier will be available on advertisement/promotion on the Site and you should review them carefully prior to any purchase.
5. In the event that the Tipping Point is not reached the credit card transaction will not be processed and no contract will come into existence and you will not be entitled to receive the Voucher at the Advertised Price.
6. The Voucher cannot be redeemed until the expiry of 3 Business Days following the Deal Expiry.
7. If the Voucher purchased by you is capable of redemption on various dates or during a specified period you will contact the Supplier by email or by telephone or in person to book the date on which you will redeem the Voucher. If the Voucher purchased by you relates to a specific date but not a specific time you will contact the Supplier by email or by telephone or in person to book the time at which you will redeem the Voucher. If the Voucher purchased by you relates to a specific date and time only you will not need to take any further action. You should ensure that you contact the Supplier to book your date for redemption of the Voucher in plenty of time so as to give you the best possible chance of booking a date that is convenient for you.
No contract for the provision of the Product/Service shall exist between you and Featured.ie. On the processing of your credit card transaction a contract shall be created between you and the Supplier. The sending of the Voucher to you by email shall constitute acceptance of your order. That acceptance shall be deemed complete and shall be deemed to be effectively communicated to you at the time the Voucher is sent to you (whether or not you receive that email). Any such contract will be deemed to have been concluded in Ireland and will be interpreted, construed and enforced in accordance with the Laws of Ireland.
While every effort is made to ensure the availability of Products/Services and to fulfil all orders, Featured.ie cannot guarantee the availability of any Products/Services displayed on the Site. Featured.ie reserves the right to discontinue the sale of any Product/Service listed on this Site at any time without notice. Our goal is to maintain a completely accurate Site. In the event that price or other errors are discovered, we will promptly correct them and the amended provision will apply. Featured.ie reserves the right to change or amend prices or promotional offers at any time without notice.
AGE, HEALTH AND SIZE RESTRICTIONS
The Products/Services provided by some Suppliers may be subject to certain age, health and size restrictions. Prior to purchase you will be informed of any such restrictions and/or will be provided with a link to the Terms and Conditions of the Supplier and it is your responsibility to ensure that you will be in a position to comply with any such restrictions. If you are unsure about whether or not you will comply with any such restrictions it is you responsibility to contact the Supplier and satisfy yourself that you will be in a position to comply prior to purchase.
In the event that you purchase a Voucher and ultimately are unable to comply with any such restrictions you will not be entitled to a refund for the Voucher nor will you be entitled to exchange the Voucher for any other Voucher.
PROBLEMS ON THE DAY
Once a booking has been made, you are bound by the Terms and Conditions of the Supplier. If you experience any dissatisfaction in relation to the provision of the Product/Service please speak to the management of the Supplier on the day in order that they have the opportunity to resolve any problems.
LOST OR STOLEN VOUCHERS
Neither Featured.ie nor the Supplier is responsible for lost or stolen Vouchers.
NO EXCHANGE OF VOUCHERS
No Voucher may be exchanged or redeemed for cash or credit, unless expressly permitted by the Supplier.
PROMOTIONAL CODES
Featured.ie may provide promotional codes which give the Customer an additional discount (at the expense of Featured.ie). Such promotional codes are deal and time specific and can only be redeemed as specifically permitted. Such promotional codes must be entered when offering to purchase a Voucher from the Site. Featured.ie reserves the right to terminate a promotional code at any time without the necessity to provide notification to any Customer or Site user.
GIFT VOUCHERS
Vouchers may be provided as gifts by Customers to third parties by selecting the ‘Gift’ option available on the Site. The Customer will be asked to provide the name and email address of the recipient. The Voucher will be sent to the recipient by email and the Customer’s details may also be sent to the recipient. By availing of the ‘Gift’ option the Customer gives his/her/their consent to his/her/their details being sent to the recipient.
PRICES AND PAYMENT
Prices are displayed in € euro. Prices are inclusive of VAT at the appropriate rates and include delivery charges at the standard rate. Promotional prices (where the previous price is struck through) indicate that these prices were listed at the original price for at least 14 days prior to this reduction.
Featured.ie accepts visa, laser card, mastercard, american express & pay pal. Featured.ie uses SSL to securely transmit your Credit Card information to Ulster Bank. Customer Credit Card Information is not stored by Featured.ie on our servers after the Deal Expiry.
EUROPEAN COMMUNITIES (PROTECTION OF CONSUMERS IN RESPECT OF CONTRACTS MADE BY MEANS OF DISTANCE COMMUNICATIONS) REGULATIONS 2001
Once a contract has come into existence between you and the Supplier it will not be possible to obtain a refund on any Voucher. This does not affect your statutory rights. However a Cooling Off Period applies under the European Communities (Protection of Consumers in respect of Contracts made by means of Distance Communications) Regulations 2001. The effect of the Cooling Off Period is that you may, within 7 days of the creation of the contract, i.e. within 7 days of the Voucher being sent to you by email, cancel your Voucher without penalty and without having to give a reason. The Cooling Off Period does not apply where the Voucher you purchase is redeemable only on a specific date. If the Voucher is redeemed within the 7 day Cooling Off Period then the right to cancel that you hold under the Cooling Off Period is automatically terminated.
LINKS TO AND FROM OTHER WEB SITES
The Site contains links to third party Web Sites. These links are provided solely as a convenience to you and not as an endorsement by Featured.ie of the contents on such third party Web Sites. Featured.ie is not responsible for the content of linked third party sites and does not make any representations regarding the content or accuracy of materials on such third party Web Sites. If you decide to access linked third-party Web Sites, you do so at your own risk. Any disputes or questions relating to merchandise from linked sites or fulfilment or delivery thereof and its quality, suitability and fitness for purpose shall be directed to the vendors and you acknowledge that Featured.ie and its affiliates, related or subsidiary companies shall have no responsibility, obligations or liability in relation to such merchandise.
Featured.ie generally welcomes the hyper-linking to the Site from other appropriate Web Sites provided such links are to the Site's homepage (and no deeper within the Site) and provided Featured.ie gives its consent to the establishment of such links. Notwithstanding the foregoing, Featured.ie reserves the absolute right to refuse to consent to such links without giving reasons. Any links to the Site from another Web Site must be presented in such a manner that the viewing of the Site is not impaired by framing or similar techniques that may impair the visitor's user experience.
LIMITATION OF LIABILITY
The aggregate liability of Featured.ie to you for all claims arising from the use of the Site is limited to the cost of any Voucher purchased by you and you acknowledge that this is a genuine pre-estimate of any loss you might suffer as a result of such a claim and is a fair and reasonable condition in all the circumstances.
Featured.ie takes no responsibility for the Products/Services for which Vouchers may be redeemed - Featured.ie makes no warranty to the Voucher end users for the quality, safety, usability, or other aspect of the product or service for which the Voucher is redeemed. Some Products/Services are activities that involve potential harm (such as skydiving, etc) and for those activities Featured.ie takes no responsibility for the Products/Services being offered and the end user takes responsibility for his or her own actions in utilising the Products/Services for which the Voucher can be redeemed.
All liability is excluded to the maximum extent permitted by law including any implied terms. The exclusions of liability set out in these Terms shall not apply to any damages arising from death or personal injury caused by our negligence, or any of our employees or agents.
The holder and issuer of a Voucher is the Supplier. As a holder and issuer of the Voucher, the Supplier shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the Supplier.
INDEMNITY
You agree to defend, indemnify, and hold harmless Featured.ie, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting whether directly or indirectly from your use of the Site or Material (including Software) or your breach of the terms of this Agreement. Featured.ie shall provide notice to you promptly of any such claim, suit, or preceding and shall assist you, at your expense, in defending any such claim, suit or proceeding.
FUTURE PROMOTIONS
To advise you of any promotional offers that may be of interest to you and to facilitate ease of use of the Site by you so that you do not have to input all your details again should you re-visit the Site your information will be held by Featured.ie (or its successors, assigns or purchasers) If you do not wish to receive information from Featured.ie about our promotional offers from time to time please email enquiry@featured.ie
TERMS SPECIFIC TO RESTAURANT VOUCHERS
For this section, Restaurant shall be defined as a merchant who offers food and beverage for sale in its regular business operations, and is making such food and beverages available to purchasers of Vouchers.
Redemption dates and times are determined by the Restaurant, and shall be contained in the voucher offer on Featured.ie.
It is at the discretion of the Restaurant to determine whether Vouchers can be combined with any other restaurant offers, third party offers, or other promotions.
Restaurant Vouchers cannot be used for taxes, tips or prior balances, unless permitted by the Restaurant.
Valid for dine in only unless otherwise stated.
The issuing of restaurant credit is at the sole discretion of the Restaurant unless otherwise required by law.
Neither Featured.ie nor the Restaurant is responsible for lost or stolen vouchers.
Reproduction, sale or trade of Restaurant Vouchers is prohibited unless done so in compliance with the law.
Any attempted redemption not consistent with these terms & conditions will render the Restaurant Voucher void.
All vouchers expire on the date specified on the Voucher.
Vouchers are redeemable in their entirety only and may not be redeemed incrementally.
TERMS SPECIFIC TO NON-RESTAURANT VOUCHERS
Vouchers may be applied only to specified Products/Services provided by the Supplier, and may not be applied to shipping or handling charges.
Limit one (1) Voucher per redemption. Only one Voucher can be used per order unless otherwise specified by Supplier.
The issuing of credit is at the sole discretion of the Supplier.
Neither Featured.ie nor the Supplier is responsible for lost or stolen Vouchers.
Vouchers cannot be combined with any other gift certificates, third party vouchers, coupons, or promotions, unless otherwise specified by the Supplier.
Reproduction, sale or trade of any Voucher is prohibited unless done so in compliance with the law.
Any attempted redemption not consistent with these terms and conditions will render the Voucher null and void.
All vouchers expire on the date specified on the Voucher.
Vouchers are redeemable in their entirety only and may not be redeemed incrementally.
INTELLECTUAL PROPERTY
The copyright and all other intellectual property rights in the material contained on the Site, together with the website design, images and source code, belongs to us and all rights are reserved.
You warrant that you are the owner, or alternatively that you have obtained the necessary consent(s) from the owner(s), of all and any material that you post on the Site.
You grant to us a non-exclusive, perpetual, irrevocable, royalty-free licence to use any material that you post on the Site in accordance with these Terms.
You warrant that you will neither (a) resell, transfer or provide to any other person the use of or access to the Site; nor (b) allow any other person access to any password, user ID or account information held by you in connection with the Site.
We grant to you a non-transferable, non-exclusive, revocable, royalty-free licence to view and print the content of the Site for your personal and non-commercial use only.
GENERAL
This Site is controlled and operated by Featured.ie from its location in Ireland. Featured.ie makes no representation that materials in the Site are appropriate or available for use in other locations. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with local laws.
Any disputes, claims or proceedings arising out of or in any way relating to the Site shall be governed by the laws of the Republic of Ireland. The Irish Courts shall have exclusive jurisdiction for the purpose of any proceedings arising out of or in any way relating to the Site. Without prejudice to the foregoing, Featured.ie may seek provisional or protective relief in the courts of another State prior to, during or after any substantive proceedings have been instituted in Ireland and Featured.ie may bring enforcement proceedings in another state on foot of an Irish judgement.
If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.
No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term.
This agreement constitutes the entire agreement between you and Featured.ie with respect to the use of the Site.
Any failure or delay by us to enforce any of the Terms shall not be considered a waiver by us of our right to enforce such term or condition of these terms.
Nothing in these Terms shall, whether directly or indirectly, give or be deemed to give any enforceable benefit of any kind to any third party as against us.
Featured.ie may at any time and without liability modify, suspend or discontinue the Site or any Materials (or any part or specification thereof), with or without notice, for any valid technical, operational or commercial reasons.
